Acceptance of These Terms

These Terms of Service govern your use of:

  • Telephone, email, and SMS communications;
  • AI-assisted communications;

By accessing the website, requesting services, communicating with NotaryWorks, scheduling an appointment, or otherwise using our services, you acknowledge that you have read and agree to these Terms of Service.

Description of Services

NotaryWorks provides professional notarial services and related administrative support services in accordance with applicable law. Services may include:

  • Oaths and affirmations
  • Certified copies where permitted by law
  • Mobile notary appointments
  • Remote Online Notary (RON) transactions
  • Loan signing appointments
  • General document signing services
  • Witnessing services where legally permitted
  • Administrative support related to scheduling and communications
NotaryWorks reserves the right to modify, suspend, or discontinue services at any time.

Eligibility

To use NotaryWorks services, you must:
  • Be legally capable of entering into binding agreements;
  • Comply with applicable laws governing the execution of documents;
  • Provide truthful and accurate information;
  • Meet all identification requirements applicable to the requested service.
Additional requirements may apply to Remote Online Notary transactions and certain specialized services.

No Legal Advice; No Attorney-Client Relationship

NotaryWorks is not a law firm and does not provide:
  • Legal advice
  • Legal representation
  • Legal opinions
  • Legal interpretation
  • Tax advice
  • Financial advice
  • Investment advice
  • Lending advice
  • Real estate advice
NotaryWorks personnel, contractors, commissioned notaries, signing agents, representatives, and AI-assisted systems do not:
  • Draft legal documents;
  • Select legal forms;
  • Interpret legal documents;
  • Explain legal consequences;
  • Recommend legal strategies;
  • Advise whether documents should be signed;
  • Determine whether a transaction is in your best interests.
Questions regarding legal rights, estate planning, real estate transactions, lending matters, or the legal consequences of any document should be directed to a qualified attorney or other appropriate professional advisor. Use of NotaryWorks services does not create an attorney-client relationship, fiduciary relationship, advisory relationship, partnership, or agency relationship.

Customer Responsibilities

Customers are solely responsible for:
  • Understanding the documents presented for signature;
  • Determining whether documents should be signed;
  • Obtaining legal, tax, financial, or professional advice;
  • Providing accurate information;
  • Presenting valid identification;
  • Ensuring documents are complete before notarization when required;
  • Providing accurate appointment information;
  • Complying with applicable laws.
Customers remain solely responsible for the legal consequences of documents they choose to sign.

Document Content Disclaimer

A notarial act authenticates a signature or the taking of an oath or affirmation. It does not validate the contents of a document. NotaryWorks does not review, verify, guarantee, or warrant:
  • The accuracy of documents;
  • The truthfulness of statements contained in documents;
  • The legality of documents;
  • The enforceability of documents;
  • The appropriateness of documents for any particular purpose.
A notarization does not constitute approval, endorsement, certification, or verification of the contents of any document.

Independent Decision-Making

Each signer is solely responsible for deciding whether to sign a document. NotaryWorks does not determine:
  • Whether a transaction is advisable;
  • Whether a document should be signed;
  • Whether a transaction is fair;
  • Whether a transaction serves a signer’s interests.
Customers are encouraged to seek professional advice before signing documents that may affect their legal rights, financial interests, healthcare decisions, or property rights.

Identity Verification and Refusal of Service

NotaryWorks is required to comply with applicable Texas laws governing identification and notarization. Valid identification and satisfactory evidence of identity are required before a notarial act may be performed. Texas law may require a notary to refuse service when identity, willingness, awareness, authority, or other legal requirements cannot be satisfactorily established. Accordingly, NotaryWorks reserves the right to refuse, suspend, postpone, or terminate services when:
  • Identity cannot be satisfactorily established;
  • Identification appears altered, fraudulent, or unreliable;
  • Fraud or misrepresentation is suspected;
  • Coercion or undue influence is suspected;
  • Elder abuse or exploitation is suspected;
  • Capacity is questionable;
  • The signer appears unwilling or unable to communicate effectively;
  • Required witnesses are unavailable;
  • The signer refuses to take an oath when required;
  • The signer refuses to acknowledge execution of a document;
  • The requested act would violate law or ethical obligations;
  • NotaryWorks otherwise lacks reasonable confidence that all legal requirements have been satisfied.
Any such refusal shall not constitute negligence, discrimination, breach of contract, or service failure by NotaryWorks. Fees associated with completed travel, scheduling, administrative preparation, or other incurred expenses may remain non-refundable to the extent permitted by law.

Remote Online Notary (RON) Services

Certain services provided by NotaryWorks are performed using Remote Online Notary (“RON”) technology in accordance with applicable Texas law. Remote Online Notary transactions may require:
  • Identity proofing
  • Credential analysis
  • Knowledge-Based Authentication (KBA)
  • Audio-video communication technology
  • Electronic signatures
  • Electronic record retention
  • Additional identity verification procedures required by law or technology providers
NotaryWorks reserves the right to refuse, postpone, or terminate any Remote Online Notary transaction if legal, technical, identity, security, or operational requirements cannot be satisfied. Not all documents or transactions are eligible for Remote Online Notary services. Customers are responsible for determining whether the intended transaction permits remote notarization under applicable law and for consulting with their attorney, lender, title company, or other appropriate advisor when necessary.

Remote Online Notary Technology Disclaimer

Remote Online Notary transactions depend upon third-party technology and internet connectivity. Accordingly, NotaryWorks is not responsible for delays, interruptions, failures, cancellations, or losses arising from:
  • Internet outages
  • Power failures
  • Device malfunctions
  • Camera or microphone failures
  • Software defects
  • Third-party platform outages
  • Telecommunications disruptions
  • Cybersecurity incidents beyond our reasonable control
  • Incompatibility of customer equipment
  • Failure of a customer to satisfy technical requirements
If technical issues prevent completion of a Remote Online Notary transaction, NotaryWorks may reschedule the appointment, require an alternative method of service, or decline the transaction if legal requirements cannot be satisfied.

Loan Signing Services

NotaryWorks may provide Loan Signing Agent services in connection with real estate and lending transactions. Loan Signing Agent services are limited to facilitating the execution of documents and performing authorized notarial acts where applicable. NotaryWorks does not:
  • Explain loan terms;
  • Interpret lending documents;
  • Provide financial advice;
  • Negotiate loan terms;
  • Recommend whether documents should be signed;
  • Approve or deny loans;
  • Represent any party to a transaction.
Questions regarding loan terms, interest rates, closing costs, legal consequences, or funding decisions should be directed to the lender, title company, attorney, or other appropriate advisor. NotaryWorks does not guarantee:
  • Loan approval;
  • Loan funding;
  • Recording of documents;
  • Completion of a transaction;
  • The legal effectiveness of any transaction;
  • Any desired outcome of a transaction.

Mobile Service and Travel Policies

NotaryWorks provides mobile services at locations requested by customers, subject to scheduling availability and applicable law. Customers are responsible for providing:
  • Accurate appointment information;
  • A safe and accessible meeting location;
  • Appropriate parking information when necessary;
  • Accurate contact information.
Travel fees, after-hours fees, emergency appointment fees, and additional charges may apply depending upon location, scheduling, travel time, wait time, and the services requested. Additional fees may apply if:
  • The appointment location changes after scheduling;
  • Excessive waiting time occurs;
  • The customer is unavailable at the scheduled time;
  • Multiple trips become necessary due to circumstances beyond the control of NotaryWorks.

Fees, Payment, Cancellations, and No-Shows

Fees for services are due as disclosed at the time of service or as otherwise agreed. Applicable fees may include:
  • Statutory notary fees
  • Travel fees
  • Remote Online Notary fees
  • Administrative fees
  • After-hours fees
  • Emergency appointment fees
  • Additional service charges
Customers may remain responsible for applicable fees if:
  • An appointment is canceled after travel has commenced;
  • The customer fails to appear;
  • The customer fails identity verification requirements;
  • The customer fails to provide required documents;
  • The customer otherwise prevents completion of the scheduled service.
Refunds, if any, shall be determined by NotaryWorks in accordance with applicable law and the circumstances of the transaction.

Communications Consent

By providing your telephone number, email address, or other contact information, you consent to receive communications from NotaryWorks that are reasonably necessary to:
  • Respond to inquiries;
  • Schedule appointments;
  • Confirm appointments;
  • Provide service updates;
  • Deliver requested information;
  • Complete requested transactions;
  • Provide customer support.
Communications may occur through:
  • Telephone calls
  • Voicemail
  • Email
  • SMS text messaging
  • Website communications
  • AI-assisted communications
  • Other reasonable methods of communication
Message frequency will vary depending upon the services requested. Standard message and data rates imposed by your wireless carrier may apply. You may opt out of non-essential SMS communications by replying STOP to any text message. For assistance, reply HELP or contact NotaryWorks directly.

AI-Assisted Communications

To improve customer service and operational efficiency, NotaryWorks may utilize artificial intelligence (“AI”) technologies to assist with administrative communications. AI-assisted systems may help facilitate:
  • Appointment scheduling
  • Customer intake
  • Service inquiries
  • Website chat
  • Telephone interactions
  • SMS communications
  • Administrative support
AI systems are administrative tools only. AI systems are not authorized to:
  • Provide legal advice;
  • Interpret legal documents;
  • Make notarial determinations;
  • Approve or deny services;
  • Determine whether identity requirements have been satisfied;
  • Provide lending, title, or financial advice.
Only a commissioned Texas Notary Public performing the notarial act has authority to determine whether all legal requirements have been satisfied. NotaryWorks does not guarantee the accuracy, completeness, or availability of AI-assisted communications and reserves the right to modify, suspend, or discontinue AI-assisted services at any time.

Website Use

Users of the NotaryWorks website agree not to:
  • Use the website for unlawful purposes;
  • Attempt unauthorized access to systems or data;
  • Introduce malware or harmful code;
  • Interfere with website operations;
  • Misrepresent identity or authority;
  • Attempt to disrupt, damage, or impair website functionality.
NotaryWorks reserves the right to restrict or terminate access to the website for violations of these Terms.

Intellectual Property

All content appearing on the NotaryWorks website, including but not limited to:

  • Logos

Disclaimer of Warranties

The NotaryWorks website and services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, NotaryWorks disclaims all warranties, express or implied, including:
  • Merchantability;
  • Fitness for a particular purpose;
  • Title;
  • Accuracy;
  • Reliability;
  • Availability;
  • Non-infringement.
NotaryWorks does not warrant that:
  • Services will be uninterrupted;
  • Services will be error-free;
  • Website functionality will always be available;
  • Technical issues will never occur;
  • Services will satisfy every customer’s expectations or intended outcomes.

Limitation of Liability

To the fullest extent permitted by law, NotaryWorks and its owners, employees, contractors, commissioned notaries, representatives, and affiliates shall not be liable for:
  • Indirect damages;
  • Consequential damages;
  • Incidental damages;
  • Special damages;
  • Exemplary damages;
  • Punitive damages;
  • Lost profits;
  • Lost opportunities;
  • Business interruption;
  • Emotional distress;
  • Loss of data;
  • Delays or failures caused by third parties.
This limitation applies regardless of the theory of liability, including contract, tort, negligence, strict liability, or otherwise. To the fullest extent permitted by law, any liability of NotaryWorks arising from or relating to the use of our website or services shall be limited to the amount actually paid by the customer to NotaryWorks for the specific service giving rise to the claim. Nothing in these Terms shall limit liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless NotaryWorks and its owners, employees, contractors, commissioned notaries, representatives, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to:
  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your misuse of our website or services;
  • Your inaccurate or misleading information;
  • The content of documents you present;
  • Your negligence, misconduct, or misrepresentations.

Force Majeure

NotaryWorks shall not be liable for delays, interruptions, or failures in performance resulting from events beyond our reasonable control, including:
  • Natural disasters;
  • Severe weather events;
  • Public health emergencies;
  • Utility failures;
  • Internet outages;
  • Cyberattacks;
  • Government actions;
  • Labor disputes;
  • Telecommunications failures;
  • Acts of God;
  • Any other event beyond our reasonable control.
In such circumstances, NotaryWorks may suspend, postpone, reschedule, or cancel services without liability.

Informal Dispute Resolution

NotaryWorks values professional relationships and encourages the prompt and informal resolution of disputes. Before initiating arbitration or litigation, a party shall provide written notice describing the dispute and allow thirty (30) days for good-faith efforts to resolve the matter informally. Nothing in this section prevents either party from seeking emergency injunctive relief where legally appropriate.

Binding Arbitration

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to the NotaryWorks website, these Terms, or the services provided by NotaryWorks shall be resolved exclusively through binding arbitration. The arbitration shall be conducted in NotaryWorks’ Texas county of residence and governed by the laws of the State of Texas. The arbitrator shall have exclusive authority to determine the interpretation, applicability, enforceability, and formation of these Terms, including any claim that all or part of these Terms is void or voidable. The parties agree that arbitration is intended to provide an efficient and cost-effective means of resolving disputes.

Class Action Waiver

To the fullest extent permitted by law, all claims shall be brought solely in an individual capacity. You waive any right to participate in:
  • Class actions;
  • Collective actions;
  • Representative actions;
  • Mass arbitrations;
  • Private attorney general actions.
Claims of multiple persons may not be combined or consolidated without the written consent of NotaryWorks.

Jury Trial Waiver

To the fullest extent permitted by law, you and NotaryWorks knowingly and voluntarily waive any right to a trial by jury in any action, proceeding, or counterclaim arising out of or relating to the use of the website or services provided by NotaryWorks.

Governing Law

These Terms of Service and any disputes arising from or relating to the website or services of NotaryWorks shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Exclusive Venue

If a dispute is determined not to be subject to arbitration, the exclusive venue shall be the state or federal courts located in NotaryWorks’ Texas county of residence. You consent to the personal jurisdiction of such courts.

Limitation Period for Claims

To the fullest extent permitted by law, any claim arising out of or relating to the website or services of NotaryWorks must be commenced within one (1) year after the event giving rise to the claim. Any claim not brought within that period shall be permanently barred.

Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

Changes to These Terms

NotaryWorks may modify these Terms of Service from time to time to reflect changes in business practices, services, technology, or legal requirements. Updated versions will be posted on the NotaryWorks website with an updated “Last Updated” date. Your continued use of the website or services following the effective date of revised Terms constitutes your acceptance of the updated Terms.
