It does not validate the contents of a document.\n\nNotaryWorks does not review, verify, guarantee, or warrant:\n<ul>\n \t<li>The accuracy of documents;<\/li>\n \t<li>The truthfulness of statements contained in documents;<\/li>\n \t<li>The legality of documents;<\/li>\n \t<li>The enforceability of documents;<\/li>\n \t<li>The appropriateness of documents for any particular purpose.<\/li>\n<\/ul>\nA notarization does not constitute approval, endorsement, certification, or verification of the contents of any document.\n\n<hr \/>\n\n<h2>Independent Decision-Making<\/h2>\nEach signer is solely responsible for deciding whether to sign a document.\n\nNotaryWorks does not determine:\n<ul>\n \t<li>Whether a transaction is advisable;<\/li>\n \t<li>Whether a document should be signed;<\/li>\n \t<li>Whether a transaction is fair;<\/li>\n \t<li>Whether a transaction serves a signer&#8217;s interests.<\/li>\n<\/ul>\nCustomers are encouraged to seek professional advice before signing documents that may affect their legal rights, financial interests, healthcare decisions, or property rights.\n\n<hr \/>\n\n<h2>Identity Verification and Refusal of Service<\/h2>\nNotaryWorks is required to comply with applicable Texas laws governing identification and notarization.\n\nValid identification and satisfactory evidence of identity are required before a notarial act may be performed.\n\nTexas law may require a notary to refuse service when identity, willingness, awareness, authority, or other legal requirements cannot be satisfactorily established.\n\nAccordingly, NotaryWorks reserves the right to refuse, suspend, postpone, or terminate services when:\n<ul>\n \t<li>Identity cannot be satisfactorily established;<\/li>\n \t<li>Identification appears altered, fraudulent, or unreliable;<\/li>\n \t<li>Fraud or misrepresentation is suspected;<\/li>\n \t<li>Coercion or undue influence is suspected;<\/li>\n \t<li>Elder abuse or exploitation is suspected;<\/li>\n \t<li>Capacity is questionable;<\/li>\n \t<li>The signer appears unwilling or unable to communicate effectively;<\/li>\n \t<li>Required witnesses are unavailable;<\/li>\n \t<li>The signer refuses to take an oath when required;<\/li>\n \t<li>The signer refuses to acknowledge execution of a document;<\/li>\n \t<li>The requested act would violate law or ethical obligations;<\/li>\n \t<li>NotaryWorks otherwise lacks reasonable confidence that all legal requirements have been satisfied.<\/li>\n<\/ul>\nAny such refusal shall not constitute negligence, discrimination, breach of contract, or service failure by NotaryWorks.\n\nFees associated with completed travel, scheduling, administrative preparation, or other incurred expenses may remain non-refundable to the extent permitted by law.\n\n<hr \/>\n\n<h2>Remote Online Notary (RON) Services<\/h2>\nCertain services provided by NotaryWorks are performed using Remote Online Notary (&#8220;RON&#8221;) technology in accordance with applicable Texas law.\n\nRemote Online Notary transactions may require:\n<ul>\n \t<li>Identity proofing<\/li>\n \t<li>Credential analysis<\/li>\n \t<li>Knowledge-Based Authentication (KBA)<\/li>\n \t<li>Audio-video communication technology<\/li>\n \t<li>Electronic signatures<\/li>\n \t<li>Electronic record retention<\/li>\n \t<li>Additional identity verification procedures required by law or technology providers<\/li>\n<\/ul>\nNotaryWorks reserves the right to refuse, postpone, or terminate any Remote Online Notary transaction if legal, technical, identity, security, or operational requirements cannot be satisfied.\n\nNot all documents or transactions are eligible for Remote Online Notary services.\n\nCustomers are responsible for determining whether the intended transaction permits remote notarization under applicable law and for consulting with their attorney, lender, title company, or other appropriate advisor when necessary.\n\n<hr \/>\n\n<h2>Remote Online Notary Technology Disclaimer<\/h2>\nRemote Online Notary transactions depend upon third-party technology and internet connectivity.\n\nAccordingly, NotaryWorks is not responsible for delays, interruptions, failures, cancellations, or losses arising from:\n<ul>\n \t<li>Internet outages<\/li>\n \t<li>Power failures<\/li>\n \t<li>Device malfunctions<\/li>\n \t<li>Camera or microphone failures<\/li>\n \t<li>Software defects<\/li>\n \t<li>Third-party platform outages<\/li>\n \t<li>Telecommunications disruptions<\/li>\n \t<li>Cybersecurity incidents beyond our reasonable control<\/li>\n \t<li>Incompatibility of customer equipment<\/li>\n \t<li>Failure of a customer to satisfy technical requirements<\/li>\n<\/ul>\nIf technical issues prevent completion of a Remote Online Notary transaction, NotaryWorks may reschedule the appointment, require an alternative method of service, or decline the transaction if legal requirements cannot be satisfied.\n\n<hr \/>\n\n<h2>Loan Signing Services<\/h2>\nNotaryWorks may provide Loan Signing Agent services in connection with real estate and lending transactions.\n\nLoan Signing Agent services are limited to facilitating the execution of documents and performing authorized notarial acts where applicable.\n\nNotaryWorks does not:\n<ul>\n \t<li>Explain loan terms;<\/li>\n \t<li>Interpret lending documents;<\/li>\n \t<li>Provide financial advice;<\/li>\n \t<li>Negotiate loan terms;<\/li>\n \t<li>Recommend whether documents should be signed;<\/li>\n \t<li>Approve or deny loans;<\/li>\n \t<li>Represent any party to a transaction.<\/li>\n<\/ul>\nQuestions regarding loan terms, interest rates, closing costs, legal consequences, or funding decisions should be directed to the lender, title company, attorney, or other appropriate advisor.\n\nNotaryWorks does not guarantee:\n<ul>\n \t<li>Loan approval;<\/li>\n \t<li>Loan funding;<\/li>\n \t<li>Recording of documents;<\/li>\n \t<li>Completion of a transaction;<\/li>\n \t<li>The legal effectiveness of any transaction;<\/li>\n \t<li>Any desired outcome of a transaction.<\/li>\n<\/ul>\n\n<hr \/>\n\n<h2>Mobile Service and Travel Policies<\/h2>\nNotaryWorks provides mobile services at locations requested by customers, subject to scheduling availability and applicable law.\n\nCustomers are responsible for providing:\n<ul>\n \t<li>Accurate appointment information;<\/li>\n \t<li>A safe and accessible meeting location;<\/li>\n \t<li>Appropriate parking information when necessary;<\/li>\n \t<li>Accurate contact information.<\/li>\n<\/ul>\nTravel fees, after-hours fees, emergency appointment fees, and additional charges may apply depending upon location, scheduling, travel time, wait time, and the services requested.\n\nAdditional fees may apply if:\n<ul>\n \t<li>The appointment location changes after scheduling;<\/li>\n \t<li>Excessive waiting time occurs;<\/li>\n \t<li>The customer is unavailable at the scheduled time;<\/li>\n \t<li>Multiple trips become necessary due to circumstances beyond the control of NotaryWorks.<\/li>\n<\/ul>\n\n<hr \/>\n\n<h2>Fees, Payment, Cancellations, and No-Shows<\/h2>\nFees for services are due as disclosed at the time of service or as otherwise agreed.\n\nApplicable fees may include:\n<ul>\n \t<li>Statutory notary fees<\/li>\n \t<li>Travel fees<\/li>\n \t<li>Remote Online Notary fees<\/li>\n \t<li>Administrative fees<\/li>\n \t<li>After-hours fees<\/li>\n \t<li>Emergency appointment fees<\/li>\n \t<li>Additional service charges<\/li>\n<\/ul>\nCustomers may remain responsible for applicable fees if:\n<ul>\n \t<li>An appointment is canceled after travel has commenced;<\/li>\n \t<li>The customer fails to appear;<\/li>\n \t<li>The customer fails identity verification requirements;<\/li>\n \t<li>The customer fails to provide required documents;<\/li>\n \t<li>The customer otherwise prevents completion of the scheduled service.<\/li>\n<\/ul>\nRefunds, if any, shall be determined by NotaryWorks in accordance with applicable law and the circumstances of the transaction.\n\n<hr \/>\n\n<h2>Communications Consent<\/h2>\nBy providing your telephone number, email address, or other contact information, you consent to receive communications from NotaryWorks that are reasonably necessary to:\n<ul>\n \t<li>Respond to inquiries;<\/li>\n \t<li>Schedule appointments;<\/li>\n \t<li>Confirm appointments;<\/li>\n \t<li>Provide service updates;<\/li>\n \t<li>Deliver requested information;<\/li>\n \t<li>Complete requested transactions;<\/li>\n \t<li>Provide customer support.<\/li>\n<\/ul>\nCommunications may occur through:\n<ul>\n \t<li>Telephone calls<\/li>\n \t<li>Voicemail<\/li>\n \t<li>Email<\/li>\n \t<li>SMS text messaging<\/li>\n \t<li>Website communications<\/li>\n \t<li>AI-assisted communications<\/li>\n \t<li>Other reasonable methods of communication<\/li>\n<\/ul>\nMessage frequency will vary depending upon the services requested.\n\nStandard message and data rates imposed by your wireless carrier may apply.\n\nYou may opt out of non-essential SMS communications by replying STOP to any text message.\n\nFor assistance, reply HELP or contact NotaryWorks directly.\n\n<hr \/>\n\n<h2>AI-Assisted Communications<\/h2>\nTo improve customer service and operational efficiency, NotaryWorks may utilize artificial intelligence (&#8220;AI&#8221;) technologies to assist with administrative communications.\n\nAI-assisted systems may help facilitate:\n<ul>\n \t<li>Appointment scheduling<\/li>\n \t<li>Customer intake<\/li>\n \t<li>Service inquiries<\/li>\n \t<li>Website chat<\/li>\n \t<li>Telephone interactions<\/li>\n \t<li>SMS communications<\/li>\n \t<li>Administrative support<\/li>\n<\/ul>\nAI systems are administrative tools only.\n\nAI systems are not authorized to:\n<ul>\n \t<li>Provide legal advice;<\/li>\n \t<li>Interpret legal documents;<\/li>\n \t<li>Make notarial determinations;<\/li>\n \t<li>Approve or deny services;<\/li>\n \t<li>Determine whether identity requirements have been satisfied;<\/li>\n \t<li>Provide lending, title, or financial advice.<\/li>\n<\/ul>\nOnly a commissioned Texas Notary Public performing the notarial act has authority to determine whether all legal requirements have been satisfied.\n\nNotaryWorks does not guarantee the accuracy, completeness, or availability of AI-assisted communications and reserves the right to modify, suspend, or discontinue AI-assisted services at any time.\n\n<hr \/>\n\n<h2>Website Use<\/h2>\nUsers of the NotaryWorks website agree not to:\n<ul>\n \t<li>Use the website for unlawful purposes;<\/li>\n \t<li>Attempt unauthorized access commissioned notaries, representatives, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, expenses, and reasonable attorneys&#8217; fees arising out of or relating to:\n<ul>\n \t<li>Your violation of these Terms;<\/li>\n \t<li>Your violation of applicable law;<\/li>\n \t<li>Your misuse of our website or services;<\/li>\n \t<li>Your inaccurate or control.<\/li>\n<\/ul>\nIn such circumstances, NotaryWorks may suspend, postpone, reschedule, or cancel services without liability.\n\n<hr \/>\n\n<h2>Informal Dispute Resolution<\/h2>\nNotaryWorks values professional relationships and encourages the prompt and informal resolution of disputes.\n\nBefore initiating arbitration or litigation, a party shall provide written notice describing the dispute and allow thirty (30) days for good-faith efforts to resolve the matter informally.\n\nNothing in this section prevents either party from seeking emergency injunctive relief where legally appropriate.\n\n<hr \/>\n\n<h2>Binding Arbitration<\/h2>\nExcept where prohibited by law, any dispute, claim, or controversy arising out of or relating to the NotaryWorks website, these Terms, or the services provided by NotaryWorks shall be resolved exclusively through binding arbitration.\n\nThe arbitration shall be conducted in <strong>NotaryWorks&#8217; Texas county of residence<\/strong> and governed by the laws of the State of Texas.\n\nThe arbitrator shall have exclusive authority to determine the interpretation, applicability, enforceability, and formation of these Terms, including any claim that all or part of these Terms is void or voidable.\n\nThe parties agree that arbitration is intended to provide an efficient and cost-effective means of resolving disputes.\n\n<hr
